Just to bring readers up to date, I have a defamation case against Paris Tenana. It was submitted on January 15, 2007, and with an extension of time I was able to apply successfully to the court on April 21, 2008 for a substituted service of the Writ to Paris at his email address.

This caused the All Aussie Wrestling forum to go nuts over laughing at the whole thing. I was laughing as well, because they were all making idiots of themselves. Paris believes he's avoided service. He hasn't. The email address I used is his, and I have enough proof of that to sink him. He got the email - therefore he was served.

The follow up directions hearing was on May 19. Now it was my turn to stuff up - but it didn't cost me the case (contrary to popular biased opinion). It simply delayed matters. I foolishly assumed that a default judgment would be automatic because Tenana hadn't filed an appearance. I was wrong - I had to formally apply for it. That was embarrassing to say the least as I tried to explain what went wrong and why. The judge wasn't happy with me and strongly recommended I get legal representation - I assume because he felt I had no idea what I was doing. I knew. I just made one foolish error. Anyway - once bitten, twice shy. Before going home once I got to back to Ballarat, I paid a courtesy visit to one of the solicitors around town to check things out. I felt a whole lot better about matters after that - and I duly filled out the appropriate application for filing.

Now I don't know when the next hearing will be (there will be one) because the registry isn't sure if the matter goes back to the Defamation judge, or the Practice Court judge. I hope it's the latter because I'll see him quicker. And I don't have to give Tenana notice either - so there will be no notification of the fact here.

The procedure as it stands now is - default judgment (including the gag order) then the damages assessment. The first one I will use straight away when I get it (no details will be revealed as to what specifically I will do). Then when I get the second I have to go to Sydney and get it registered in New South Wales. That's when I'll apply for the warrant through the Sheriff's office, and they will get Paris's residential address and issue it. It's not a warrant for arrest. It will be a warrant to enforce compliance with the orders - as I understand the rules. I don't know when I'll get to Sydney to do that, but if it's before the end of August it's likely I'll fit in an edition of Phil's Weekend and maybe a wrestling show as well. It depends on what fits where though.

And just to make sure, I'll set things up in other areas so he can't escape justice.

So if anyone thinks I've lost - they are VERY wrong!

Oh and one more thing in this update. The password protected area is now empty. This is due to Tenana breaking into the section and publishing it on the AAW forum. A heinous act if ever I've seen one and loaded with the very maliciousness that got him into trouble with me to begin with. It should be removed soon.

UPDATE #1

Seems that it's being claimed that the files that Paris hacked into weren't protected. They were, and my web host is looking into the break in. And what was said - is the truth. If those who were targeted want to claim defamation they can go right ahead. I have plenty of proof to show what I said was in fact true.

Oh - and ask certain WWE wrestlers if Dave Ayling was dangerous! I rest my case on that one!

Sheriff's enforce warrants. If I get a warrant to enforce a gag order, they'll do it. And I'm gagging Paris Tenana - who is identified (with proof) by the usernames on file in the County Court. The court has the original templates. Defamation has nothing to do with physical threats and I need no witnesses because it's all there in writing. Because Paris isn't contesting this, there is no counter evidence. Funny he makes all these claims to the contrary - but won't come down to Melbourne to back it up!

I typed part of this up just before I left for Hobart, and while I was away, AAW was suspended. Good. Thank you to Lee and Scratcher for recording stuff before it went.

What part of "delay" doesn't Tenana understand? No one won or lost on May 19. The matter was delayed. And I can represent myself in Sydney as Scratcher said on the talk page - easy peasy. Tenana did need to be there because he was served on April 23. He chose not to be. So it's on his head. When I get to Sydney with the orders the matter will have already been settled.

One for Bednarz - AKA another liar. There were no open files in the password protected area. My webhost found the breach by the way and it has now been closed. Unfortunately it was too long ago for them to track down any IP that may have used it, and it also didn't help that I'd deleted the directories (a case of a two edged sword). Not to worry - they know the directories were password protected, so AAW had better remove that content when the suspension ends! Note also that I only made that update about trying to hack his site AFTER the latest threat to mine (earlier this month). I didn't bother up until then even though the page had been there since last year. No hypocrisy - self defence response. But of course this lot don't believe in that do they?
